Need someone to support with your financial affairs?
There may come a time when you are no longer able or no longer want to make decisions regarding your own financial affairs. In these types of situations, you are able to attain a legal document called a ‘Power of Attorney’, which will allow someone else to make decisions for you and act on your behalf. You may feel it necessary to have a ‘Power of Attorney’ if for example:
You are in hospital and need help with everyday tasks such as paying bills (on a temporary basis)
You have been diagnosed with a longer-term illness, such as dementia, and you may lose the mental capacity to make your own decisions in the future
There are different types of ‘Power of Attorney’s’ that can be applied for, depending on your circumstances. We have provided a brief summary below but for more information please visit Age UK
Ordinary/General Power of Attorney
This legal document would allow someone to make decisions about your financial affairs whilst you still have mental capacity. For example, this may be suitable for a temporary period to help you whilst you are in hospital or on holiday. This may also be useful if you find it difficult to go out or simply want someone to act on your behalf.
Lasting Power of Attorney (LPA)
This legal document would allow someone to make decisions about your financial affairs and/or your health care. It will only come into effect if you lose mental capacity or if you no longer want to make decisions for yourself. It is common that some families arrange an LPA as a precaution.
Enduring Power of Attorney (EPA)
EPAs were replaced by LPAs in October 2007. However, if you made and signed an EPA before 1 October 2007, it should still be valid. An EPA covers decisions about your property and financial affairs. It will come into effect if you lose mental capacity or if you no longer want to make decisions for yourself.
